Application Summary

A proposal to demolish the existing 71,250 sq. ft. of commercial buildings and construct 269 residential units and ~20,000 square feet of commercial space. The project would consist of 18 buildings: three rowhouse buildings, 13 townhouse buildings, one building with 48 age-restricted affordable units and one mixed-use residential building with 123 residential units and 35 memory care rooms (in an assisted living facility) and about 20,000 sq. ft. of commercial space. The proposal included state Density Bonus waivers including, but not limited to, building height, slope setback and affordable unit dispersal requirements. The project has been modified multiple times since original approval in August 2020.

The project has been revised to revise the underground garage layout in mid-2021, a revision to the Vesting Tentative Map for the project to create a parcel for the affordable housing portion of the project in Fall 2021 and modifications to the assisted living facility to adjust the mix of assisted living, reduce the amount to commercial uses to 12,000 sq. ft, reduce the underground parking spaces and reduce the massing of the top floor to accommodate an aqua therapy pool in late 2021.

Development Permit Amendment and Architectural & Site Approval to modify Building 1 to increase the residential unit from 123 units to 136 units (an overall increase of 13 units), eliminate the basement-level parking garage, reduce the ground floor retail from ~12,000 sq. ft. to 4,000 sq. ft., and a request to waive the Park Land Dedication Fee. Modifications to the approved Westport project to revise the underground garage layout to limit the footprint to portions of the site below Building 1 and add additional subterranean level located at 21710 Stevens Creek Boulevard, APN 326-27-043.

TM-2021-002

On September 7, 2021, the City Council approved a Vesting Tentative Map to replace a previously approved Vesting Tentative Map (TM-2018-03) for the Westport Cupertino development project to create a separate parcel for the age restricted senior below market rate building.

Stevens Creek Bus Stop Location

At the meeting, City Council requested that staff:

1) Provide a written explanation for the relocation of the bus stop from the eastside (nearside) of the Stevens Creek Boulevard/Mary Avenue intersection, to the westside (farside) of the intersection.
2) Investigate the usage of the bus stop at Mary Avenue and Stevens Creek Boulevard by patrons of the Cupertino Senior Center.
3) Report back to Council on potential additional measures that may help enhance the safety of pedestrians using the Stevens Creek Boulevard/Mary Avenue intersection.

This Staff Follow-up Report was prepared by Chad Mosley, Assistant Director of Public Works and sent to the Council on November 19, 2021.

Modify the approved Westport Development project by:

  • Adjusting unit mix in the assisted living facility (Building 1) from 131 assisted living units and 27 memory care units to 123 assisted living units and 35 memory care rooms (an overall reduction of 8 units to the total project unit count since memory care units are not classified as "living units"),
  • Eliminating a requirement to allow public dining at the assisted living facilities private dining area (a reduction of ~8,000 square feet of commercial square footage),
  • Reducing the underground parking to reflect adjustments in uses,
  • Reducing the massing on the top floor to accommodate an aqua therapy pool.

2020 Application

The 8.1-acre project site is the existing Oaks Shopping Center on Stevens Creek Boulevard. The project site is currently developed with five buildings totaling approximately 71,250 square feet. The proposed project would demolish the existing buildings and construct 242 residential units and 20,000 square feet of commercial space. The project would consist of 18 buildings: three rowhouse, 13 townhouse, and two mixed-use residential buildings that would include 39 Below Market Rate senior housing. The project would include 37,601 square feet of common open space and 2,400 square feet of common retail outdoor space. The project is also requesting Density Bonus waivers for building height, slope setback and BMR unit dispersal.
