Parking enforcement for street sweeping will restart on Monday, June 28, 2021.

 

The Code Enforcement Division works to keep Cupertino safe and attractive by ensuring that properties comply with the policies, processes, and municipal laws associated with Community Development functions. These functions include development planning, building construction, habitability of housing stock, fire prevention, elimination of life safety issues, public nuisances, and parking enforcement. Code Enforcement staff works closely with members of the public to educate and gain voluntary compliance with the Cupertino Municipal Code.

 The Code Enforcement Division is part of the Community Development Department and is comprised of a staff of three full-time and one part-time Officers who together respond to reports six days a week, Monday through Saturday. Code Enforcement is responsible for upholding the provisions set by the Cupertino Municipal Code and various other related codes and policies. To meet this obligation, we obtain compliance through intervention, education, and enforcement. We strive to partner with the community in enforcing neighborhood property maintenance standards, as it is our goal to help maintain property values and create a safe, healthy, and aesthetically pleasing community. Effective Beginning July 1, 2018 - Parking Ticket Payment Plans and Low-Income (“Indigent”) Considerations

The City of Cupertino offers a payment plan for customers who are determined to be indigent under specified criteria. A person may apply for a determination of indigence and to pay a citation in installments within 60 days of the citation’s issuance or within 10 days after the hearing determination (whichever is later).

The payment plan allows a maximum monthly payment amount of $25.00 if the amounts due total $300.00 or less. The maximum timeline for full payment under a plan is 18 months.

There will not be a processing fee.

  • An approved application may also:
    Waive all late fees and penalty assessments if an indigent person enrolls in the payment plan. Waived late fees and penalty assessments will be reinstated if the person falls out of compliance with the payment plan.
  • Provide a one-time only option for an indigent person to enroll in a payment plan for tickets prior to 7/1/18 and/or for tickets after 7/1/18 where the 60 day requirement was not met, even tickets on hold at DMV, and have the hold rescinded and late fees waived.
  • Allow a one-time late payment of up to 45 calendar days from a payment plan due date. The payments must resume by the end of the 45 days. Waived late fees will be reinstated if the person falls out of compliance a second time, and the payment plan will be cancelled.

Per Government Code 68632 (a), a person may be determined indigent if they provide documentation they are receiving public benefits under one or more of the following programs:

  • Supplemental Security Income (SSI) and State Supplementary Payments (SSP). Documentation required is two of your most recent benefit check stubs or statement and certification from the county’s Social Services office.
  • California Work Opportunity and Responsibility to Kids Act (CalWORKs). Your Golden State Advantage Card (EBT) is required as documentation.
  • Supplemental Nutrition Assistance Program (SNAP). Your Golden State Advantage Card (EBT) is required as documentation.
  • County Relief, General Relief (GR), or General Assistance (GA). Verification from the County Service Office is required for documentation.
  • Cash Assistance Program for Aged, Blind, and Disabled Legal Immigrants (CAPI). Verification from the County Service Office is required for documentation.
  • In-Home Supportive Services (IHSS) (Article 7 9commencint with Section 12300) of Chapter 3 of Part # of Division 9 of the Welfare and Institutions Code. Your Medi-Cal card will be required for verification.
  • Medi-Cal Documentation.

Alternatively, per Government Code 68632 (b), a person may be determined indigent if their monthly income is 125 percent or less of the current poverty guidelines updated by the US Department of Health and Human Services. Documentation required can be a recent paystub or bank statement verifying income.

If a person’s indigent status is found to have been willfully fraudulent, his or her fines and fees reduction shall be overturned and the full amount of tines and fees shall be restored.

Who is responsible for the control and eradication of vermin (rodents)?

The Santa Clara County Health Department, Vector Control Division is the agency that is responsible for investigating situations involving rodents and other vermin within Cupertino. Contact them at 408.918.4770 or 800.675.1158.

Is it a code violation to have a home business?

No, in most cases home occupations are permitted. Home occupations are regulated by the municipal code and are subject to the securing of a business license. Generally, home occupations are permitted if they do not have an impact on the neighborhood by means of excessive noise, traffic, visual blight, etc.

Who is responsible for cutting back shrubs and foliage that is obstructing the sidewalk?

Private property owners are required by the municipal code to prune all shrubs and foliage in such a manner that they do not encroach into the sidewalk and/or street. If the foliage is city owned/maintained (such as a street tree), the City Streets Division will prune back the foliage.
